Haryana Government Bill Sanctioning 75% Quota for Locals in Private Jobs

The Haryana Government has approved the Haryana Reservation Bill to provide 75 % quota for locals(Haryana Domicile) in Private Jobs.

The Haryana State Employment of Local Candidates Bill, 2020, tabled in the legislative assembly last year by Deputy Chief Minister Dushyant Singh Chautala , was approved by Governor Satyadev Narayan Arya on 2nd March 2021.

According to the notification, the Haryana State Employment of Local Candidates Bill, 2020, provides reservations to local people in private-sector jobs that offer a salary of less than Rs 50,000 a month. However, the reservation will initially apply for 10 years.

Applicability –

This Act applies to all the Companies, Societies, Trusts, Limited Liability Partnership Firms, Partnership Firms and any person employing ten or more persons and an entity, as may be notified by the Government from time to time.

Local Candidate

Means a candidate who is domiciled in the State of Haryana.

Compulsory Registration on designated Portal (section 3) –

On and from the date of commencement of this Act, every employer shall, register such employees receiving gross monthly salary or wages not more than Rs.50000/- (fifty thousand rupees) or as notified by the Government, from time to time, on the designated portal, within three months of coming into force

Provided that no person shall be employed or engaged by any employer till the registration of all such employees is completed on the designated portal.

Mandatory 75% Employment of local candidate

As per section 4, every employer shall employ 75% of local candidates with respect to such post where the gross monthly salary or wages not more than Rs.50000/-

Who are the locals and how will it benefit them?
According to the law of the state, a candidate who is domiciled in Haryana is called a local candidate and will be able to avail the benefit of this reservation while seeking employment in the private sector. For availing other job facilities, the candidates will also mandatorily have to register themselves on a designated portal. Moreover, the employer will have to make recruitments through this portal, only.

Seeking Exemption – As per section 5 the employer may approach Designated office (Deputy Commissioner) for exemption from the provisions of section 4 where adequate number of local candidates of the desired skill, qualification or proficiency are not available.

Quarterly Report – As per section 6 employer have to file quarterly report at portal and government office as may be prescribed.

Penalties  for not following provisions of the law?
A penalty ranging from Rs.10000 to Rs. 200000. (Two Lakh Rupees) would be imposed on the employer on the failure to adhere to the law.
